Definition of the Article 1 term
1. Data: The data which software and software use.
2. Service: Service to make it possible that a user acquires data made in CreDes which a server of CreDes provides and the data which a user was registered with using the Internet.
3. A user: All users who registered of CreDes.
An application and change of Article 2 Terms of Use
1. This agreement shall be applied about a user and use of service of CreDes. It is considered that the user agrees to this agreement at the same time to have registered.
2. CreDes shall be able to change this agreement without getting the consent of the user based on a judgment of the original discretion. In addition, I cancel a part of the element of the service or all and shall be able to revise it, and the user shall follow the Terms of Use after the change about every condition.
3. After this agreement revision, this agreement shall be applied to CreDes and all relations between the user. I shall notify a user of a change by service only when radical change and CreDes judge it.
4. I consider that the notice to a user was completed with a point in time when the notice was posted on service, and, without the formal objection from a particular user, a user considers it to have agreed to the contents of the notice ten days after a notice.
About Article 3 charge
1. I shall be able to use the data made in CreDes provided by service free or for a fee.
2. About distributing data made in CreDes provided by service the second use or the second, and providing it for a user or a third party, the second use or the second person whom I distribute it and provided shall solve CreDes without participating.
3. There shall be a thing prohibiting the second use or the second distribution for data made in CreDes provided by service. I shall show the notice of the prohibition of the second use or the second distribution on a part targeted for the service.
4. CreDes does not participate in all relations about a different user or a third party using the data which a user registered and it is a user and a user or a person or shall solve it in third parties.
The use of the Article 4 service
1. The start of the service offer shall be started since I read the URL that e-mails the validation of the account that is transmitted by CreDes after having registered, and is listed.
2. The user's registration performs the cause that is the input of the person using service, and the consent is the transmission of the validation email of the account, and a service offer of CreDes shall be performed.
3. I recognize CreDes as the person who registered, and the act to log in to service by ID and a password shall provide service.
4. When ID or a password is used more any place other than a user, CreDes shall not take all responsibility regardless of a reason about the user and other damage.
5. When ID or a password is used by the person except the user, and CreDes suffers damage, the user shall compensate it for all damage that CreDes put on regardless of after progress during a service period of use and a period.
6. The user concerned shall assume an obligation of the compensation for damages for CreDes regardless of having stopped the service to the user concerned when CreDes suffers damage by a user corresponding to one of Article 9.
Prohibition of the Article 5 usufruct transfer
1. The user transfers a right about the use of the service to a third party or buys and sells it unless there is an agreement particular separately by CreDes, and there shall not be the act such as offering it to a name change, the setting or other securities of the right of pledge.
Facilities of the Article 6 user
1. The user prepares for a computer, communications equipment, a phone line, a connection line, data to the Internet, all other apparatus facilities necessary to use service in responsibility and the expense burden on self and shall bear the communication expenses such as telephone rates, the connection fee in responsibility and an expense of the self.
2. When it is admitted that the facilities mentioned above interfere with service of CreDes, I can stop use without prior notice and do CreDes with a thing.
3. The user shall observe a condition to establish of CreDes about facilities of the use, the use technique to service and the usage of the service.
Article 7 guarantee
1. The guarantee by CreDes is not given regardless of clear statement, an apocalypse at all, and the service decides to be provided only in a state to have when I am provided. But it is not the limit about the thing that the exclusion of the application to a limit are not recognized by the guarantee with the legal application of Japan.
The observance of Article 8 laws and ordinances
1. The user must observe all laws (not only a Japanese federal law, I include the law of foreign countries to be related to) applied about the use of the service. The user shall observe a rule recognized as fairness generally about the appropriate use of Internet-related resources. I shall be able to stop service without notifying a user that CreDes is against these laws and ordinances when I judge it.
Stop of the use of Article 9
1. When I judge that CreDes corresponds to the following items, I shall be able to stop CreDes without I notify a user of the use of the user for all services by a judgment of the original discretion beforehand or notifying it until a violation state to suffer from dissolves.
(1) When a user violates either article of this agreement.
(2) When a user does an act against profit of CreDes.
(3) When, about a user, I received the business suspension of the license of the clearing house.
(4) When, about a user, I receive seizure and disposition for failure to pay taxes about the assets of the user.
(5) When, about a user, there is the reason of the statement of the bankruptcy, a civil affair reproduction procedure, company corporate reorganization, company rearranging or the special settlement.
(6) When there is the statement of the bankruptcy about a user or when I receive the umpire of a tutelage start or the assistance start.
(7) When it is admitted that I affect it in the duties accomplishment of the service of CreDes.
(8) In addition, when I judge CreDes to be inappropriate as a user.
Effect of the stop of the loss of the Article 10 user qualification and the use
1. When CreDes stops the use of the service according to this agreement Article 9, the user loses a right of the access for all accumulated data and does not assume obligation that CreDes lets it is any form and use they data or the copy for the user concerned.
2. I continue each article about all of responsibility of the user and limits for the user after one of a stop of the use of the service of the user or service and shall maintain complete effect, and the user shall compensate it for all damage of CreDes which I put on by this agreement violation, limit violation regardless of after in progress during for a service period of use and a period.
The cancellation of the Article 11 service or interruption
1. About the administration of the service, I watch the use of this service, and CreDes can limit the access to this service in a judgment of the original discretion when I admit that it is necessary.
2. When I correspond to the following matters, I cancel the administration of this service or shall be able to stop CreDes.
(1) When I regularly or urgently perform the maintenance of facilities providing service.
(2) When, by war, a riot, turmoil, a labor dispute, an earthquake, eruption, a flood, a tsunami, a fire, blackout or other states of emergency, the offer of this service is not possible as usual.
(3) In addition, when CreDes judges temporary interruption to be necessary in the administration of the service.
3. When CreDes cancels the administration of the service by the rule of the foregoing paragraph or I stop it, I shall notify a user of so beforehand. But it is not this limit when it is urgently unavoidable.
4. CreDes sets a limit to the access to service and it is a user or a person or, by outbreak such as the cancellation of the service or the interruption, shall not take responsibility for all regardless of a reason about any damage that a third party put on.
Use of the Article 12 information
1. I collect information (histories) that CreDes was able to know in the process when a user uses service and shall use CreDes for the purpose of the service offer.
2. CreDes shall not disclose information prescribed in a foregoing paragraph to a third party unless I correspond to the following items.
(1) When disclosure is demanded by the compulsory execution based on Criminal Procedure Code or other laws and ordinances by state organs.
(2) When when CreDes entrusts the provider of the server with a part of the office work to occur due to this service, I disclose the information that is necessary for the processing in the bond-issuing company.
(3) When I use gleanings (the information group that the individual of the user cannot identify) for the purpose of grasping the use trend of this service to carry out the development of the expansion of the existing service, the new service as statistics data, and CreDes discloses it as needed in the duties business partners.
(4) When CreDes discloses it due to the administration trust of the service, a business transfer.
Definition of the Article 13 copyright
1. The right about all data, information, procedures, trademarks, business names to constitute service and technical whole associated with these belongs to CreDes, and the user shall not have to perform an act to violate these rights at all.
2. The user shall not be able to use the range outside establishing any information offered through service or data in Copyright Act in any method.
3. CreDes assumes the data which a user contributed the book of the user, but shall use the data without performing a preliminary notice for the purpose of the service offer. But CreDes cancels use when there is the statement from a user holding the data which I used.
4. When the use that the data which a user contributed determine in Copyright Act out of the range was performed by a third party, CreDes shall not take all responsibility.
5. When a dispute occurs in violation of a rule of Honjo, the user solves the dispute concerned in an expense and responsibility of the self and discharges CreDes in any case and shall not cause damage again.
Article 14 transfer
1. CreDes transfers the right based on this agreement to the group businesses of CreDes without getting the prior consent of the user and shall be able to let the group businesses concerned undertake the duty based on this agreement again, and the user agrees to this without demur.
Article 15 disclaimers
1. CreDes shall not take responsibility for all unless there is fate about the damage of delay, a change, interruption, cancellation, the stop in the service offer and the abolition, the user who occurred in conjunction with registration or being washed away such as the provided information or disappearance and other services through service or the third party separately.
2. About the damage by having used the offer information in the service offer, CreDes shall not take all responsibility.
3. About the influence on terminal equipment and data of the user in the service offer, CreDes shall not take all responsibility.
Article 16 separability and the right non-abandonment
1. The use of the right to fix for this agreement, negligence of the enforcement are not things meaning the abandonment of the right.
2. When either article of these agreements catches invalidity, the illegally equal の judgment in a certain jurisdiction place, other articles still have effect and retain it.
The agreement that Article 17 is complete
1. This rule shall constitute CreDes and the complete agreement of the user regardless of word of mouth or the written negotiations, promise, consent.
An Article 18 governing law and jurisdiction
1. Execution possibility, the interpretation of this agreement and the effectiveness shall be judged according to a Japanese federal law.
2. When a dispute occurs in conjunction with service between user and CreDes, the person concerned concerned shall discuss it in all sincerity together.
3. When it is not settled even if I discuss it by a foregoing paragraph, I assume a court having jurisdiction over the head office location of CreDes an exclusive jurisdiction court of the first trial.
